Description

Background
The Board of Industrial Insurance Appeals (BIIA) is a quasi-judicial tribunal established in 1949 to hear appeals from decisions made by the Washington State Department of Labor and Industries (L&I).

The BIIA's mission is to serve the public by resolving appeals in a consistent, impartial, timely, and efficient manner. The current solicitation seeks an experienced workers' compensation attorney to represent a claimant in an appeal before the BIIA, as ordered by the Board under GR 33 and the Americans with Disabilities Act.

Work Details
The attorney will provide legal representation for a claimant appealing Department orders that rejected three claims and set wage rates in an accepted claim. Responsibilities include:
- Providing effective legal representation consistent with the Rules of Professional Conduct, Court Rules, and BIIA rules as per WAC 263-12.
- Submitting monthly statements detailing hours worked and descriptions of work performed, billed in increments of 0.1 hours.
- Maintaining professional liability insurance with coverage limits of at least $200,000 per claim and $500,000 in aggregate liability.

The attorney must have significant experience in workers' compensation hearings and trials and be able to provide representation via in-person meetings, videoconferencing (e.g., Zoom), and telephonic communication.

Period of Performance
The performance period begins upon the attorney's appointment and continues until the completion of all proceedings at the BIIA, including mediation, hearings, and any necessary Petition for Review.

The period may be modified by written agreement between the attorney and the BIIA.

Place of Performance
The legal services will be performed at the BIIA headquarters located at 2430 Chandler Ct. SW, Olympia, WA 98501.

Bidder Requirements
Bidders must be attorneys eligible to practice before the Board of Industrial Insurance Appeals with experience representing individuals injured or disabled due to on-the-job injuries. Additionally, bidders must maintain professional liability insurance as specified above.
