Background
This Request for Qualifications (RFQ) is issued by the Governor’s Office of General Counsel on behalf of the State Public School Building Authority (SPSBA) and the Pennsylvania Higher Educational Facilities Authority (PHEFA).
The purpose of this RFQ is to establish a Bond Counsel Pool that will be utilized by various educational institutions, including School Districts, Community Colleges, Career and Technical Centers, Intermediate Units, and Public/Private Colleges and Universities. The goal is to retain qualified law firms as Bond Counsel for the issuance of taxable and tax-exempt bonds on an ad hoc basis.
The Commonwealth aims to select law firms based on specific criteria outlined in this RFQ.
Work Details
Law firms are invited to submit qualifications for inclusion in a Bond Counsel Pool. Selected firms will provide legal services related to the issuance of taxable and tax-exempt bonds by SPSBA and PHEFA.
Inclusion in the pool does not guarantee work; it merely qualifies firms for potential selection by schools for bond counsel services. Firms must demonstrate their experience with bond issuances, provide personnel qualifications, and detail their approach to meeting the requirements set forth in the RFQ.
Additionally, firms are required to meet Small Diverse Business (SDB) and Veteran Business Enterprise (VBE) participation goals.
Period of Performance
The term of inclusion in the Bond Counsel Pool will commence upon receipt of an Appointment Letter from the Issuing Office and will last for one year from that date.
The Commonwealth reserves the right to terminate the Bond Counsel Pool at any time.
Place of Performance
The services will be performed primarily within Pennsylvania as needed by various educational institutions across the state.
Bidder Requirements
To be eligible for selection, law firms must comply with SDB and VBE participation goals as specified in the RFQ. Firms must also provide documentation demonstrating good faith efforts to meet these goals if they cannot fully comply.
Additionally, law firms must not be under suspension or debarment by any governmental entity.
