Description

The contracted Mediator will be assigned claims facilitated by the Real Estate Division through the Alternative Dispute Resolution program, and is expected to fairly, objectively and expeditiously conduct mediations between Claimants and Respondents as mandated by NRS 38, utilizing knowledgeable interpretations of NRS 116 as well as the Covenants, Conditions and Restrictions (governing documents) of the homeowner association(s) involved
Background
The Nevada State Purchasing, on behalf of the Business and Industry, Nevada Real Estate Division – Office of the Ombudsman for Common-Interest Communities and Condominium Hotels, is seeking proposals from qualified vendors to provide arbitration/referee services. The goal of this contract is to facilitate Alternative Dispute Resolution (ADR) claims between Claimants and Respondents as mandated by NRS 38. This will involve knowledgeable interpretations of NRS 116 and the governing documents of the homeowner associations involved.

Work Details
The contracted Mediator will conduct mediations fairly, objectively, and expeditiously. Specific services include:
- Conducting referee/arbitration hearings;
- Drafting written decisions based on outcomes;
- Interpreting covenants, conditions, or restrictions applicable to residential property;
- Addressing procedures for assessments in homeowner associations;
- Maintaining accurate records of subsidy amounts dispensed by the Division;
- Notifying parties of assigned Referee/Arbitrator details; and
- Issuing written decisions within specified timeframes.
Referees/Arbitrators must possess an active Nevada State Bar License and have at least two years of experience in adjudicating ADR matters.

Period of Performance
The contract term is expected to be four years, subject to Board of Examiners approval.

Place of Performance
Services will be performed within the geographic locations relevant to the claims assigned, primarily involving homeowner associations in Nevada.

Bidder Requirements
Vendors must be registered at nevadaepro.com and hold a valid Nevada business license. They must also comply with NRS 333.311 regarding mandatory minimum requirements, including not requiring arbitration disputes to be heard outside Nevada and agreeing not to engage in a boycott of Israel during the contract term.
