The City of Clifton is seeking proposals for Special Counsel for Employment Litigation Claims for the contract period of 2026-2027. The goal is to engage a qualified attorney or law firm to provide comprehensive legal services related to employment law and human resources.
Work Details
The selected Respondent will provide legal advice and representation concerning various employment litigation matters, including but not limited to: employment discrimination (based on disability, age, race, religion, or sex), wrongful termination, discriminatory harassment, sexual harassment, Conscientious Employee Protection Act (CEPA) claims, New Jersey Law Against Discrimination (LAD) claims, family and medical leave claims, retaliation claims, and severance agreements.
The firm will be responsible for filing necessary pleadings and documents with appropriate courts or administrative agencies. Services may include drafting pleadings, motions, briefs; conducting discovery; attending pre-trial, trial, and post-trial court appearances; and handling appeals. The Respondent must also have sufficient resources to advance all costs and must comply with conflict of interest policies.
Period of Performance
The contract will be performed over a period of one year from the date of contract execution.
Place of Performance
The services will be performed in Clifton, New Jersey.
Bidder Requirements
Respondents must be licensed to practice law in New Jersey and have at least five consecutive years of experience in employment litigation matters representing municipalities or public entities. They must demonstrate knowledge of relevant laws including NJLAD and NJCRA. Additionally, they must maintain a bona fide office in New Jersey and have represented at least three public entities in similar matters within the last three years.
The Respondent must also maintain professional liability insurance of at least One Million Dollars per occurrence.
