Background
The Taunton Housing Authority (THA) is a quasi-governmental entity established in 1948, funded federally through the Department of Housing and Urban Development (HUD) and the Massachusetts Department of Housing and Community Development (DHCD). The purpose of this solicitation is to seek qualified legal consulting services to assist THA in various legal matters, particularly those related to public housing and compliance with relevant laws.
Work Details
The selected legal consultant/firm will provide as-needed legal services in several areas including:
1. **Construction/Real Estate**: Counsel familiar with residential and commercial leases, ADA compliance, licenses, titles, easements, and local/state codes. Representation in rehabilitation projects and new construction financed by federal or state funds.
2. **Civil Rights/Constitutional Law**: Experience in litigating and advising public entities in civil rights matters.
3. **General Civil Litigation**: Defense against tort/civil litigation claims with sufficient staffing for prompt responses.
4. **Contract Law**: Legal counseling for procurement contracts including negotiation, review of bids, and contract administration.
5. **Landlord/Tenant Law**: Representation in eviction actions and nonpayment cases.
6. **Public Sector/Federal Housing Law**: Expertise in obligations to HUD and DHCD for housing authorities.
7. **Affordable/Public Housing Law**: Experience managing affordable housing units.
8. **Administrative Law**: Knowledge of enforcement powers of agencies, ethics, Public Records Act compliance, and agency powers.
Period of Performance
The contract will be awarded for one year starting from August 1, 2025, to July 31, 2026.
Place of Performance
Legal services will primarily be performed at the offices of the Taunton Housing Authority or as required at other locations pertinent to specific cases.
Bidder Requirements
Respondents must demonstrate qualifications including experience representing public entities; provide evidence of a valid Massachusetts Bar Association license; maintain professional liability insurance of at least $2 million per occurrence; comply with workers' compensation regulations; provide commercial general liability insurance; and automobile liability coverage as specified. Respondents must also submit a statement of qualifications detailing areas of practice specialization along with three references from similar clients.
