Outside Legal Counsel for PFAS Litigation

Background
The Palm Beach County Board of County Commissioners is seeking proposals for outside legal counsel services to advise and represent the County in litigation related to per- and polyfluoroalkyl substances (PFAS) contamination.

This initiative aims to pursue damages incurred by the County due to chemical companies' pollution of its natural resources. The selected legal counsel will operate on a contingency fee basis, meaning they will incur all costs without guaranteed payment unless the litigation is successful.

Work Details
The selected outside legal counsel will provide comprehensive legal representation for the County in all aspects of PFAS litigation, including any related appeals and counterclaims.

The firm must demonstrate strong qualifications and expertise in complex litigation, particularly in mass torts, product liability, multi-district litigation, or class actions. The firm is expected to handle all aspects of the litigation independently, without involvement from the County Attorney’s Office. Proposals must include detailed experience in similar cases, a list of clients served in the past five years, and a narrative outlining potential causes of action and risks associated with the litigation.

Period of Performance
The contract will commence upon approval by the Board of County Commissioners and will continue until the conclusion of the litigation, including any appeals or counterclaims.

Place of Performance
The services will be performed in relation to cases concerning Palm Beach County's natural resources affected by PFAS contamination.
