Adult Indigent Defense

Background
San Bernardino County is seeking Proposals from interested and qualified Proposers to provide defense representation services under appointment by the Superior Court of California, County of San Bernardino (Superior Court) to the County’s adult indigent defendants without sufficient financial means or otherwise unable to obtain legal representation, but that the County Public Defender is legally unable to represent. The current contract, in effect from July 1, 2019, to June 30, 2024, was awarded to a private law firm administrator, and covers the four Superior Court regions that comprise the entirety of San Bernardino County --- West Valley, East Valley, North Desert and East Desert.

Work Details
The Contractor shall perform administrative and legal services including furnishing associate counsel necessary for daily representation in various departments and divisions of the Superior Court for the Contractor’s contract region(s).
The Contractor shall also provide other personnel ancillary to the furnishing of legal services, office space, all materials, equipment, facilities, and supplies necessary for support of personnel.
The Contractor shall serve a single region, combination of regions, or countywide according to the provisions of the contract.
The Contractor shall ensure that all clients represented under the contract receive effective assistance of counsel under the Constitutions of the United States and the State of California; and the State Bar of California Rules of Professional Conduct.

Period of Performance
The Contract period will be for a maximum of five years beginning on July 1, 2024, and ending on June 30, 2029. In the event of expiration of the contract or termination for other than cause, the Contractor shall continue to provide representation for a period of up to ninety (90) days following the last day for which the contractor was eligible for appointments.

Place of Performance
Location(s) where Services are to be provided include any Superior Court work locations where criminal matters are heard and County detention facilities where defendants are housed.
