Overview

Grant Description
This application utilizes FFY 2021 Section 5309 ARP Act Capital Investment Grants funding to prevent, prepare for, and respond to coronavirus. This application includes the full $6,254,183 (Discretionary ID# D2021-RPSS-016) apportionment to UTA for the Ogden/WSU Bus Rapid Transit Project.

Purpose

This grant supplants a portion of the non-CIG matching funds for the Ogden/WSU Bus Rapid Transit Project in Grant ID# UT-2021-021. It does not duplicate the federal funding for any activities in Grant ID# UT-2021-021 nor in the existing and in-development CMAQ/STBG Grants UT-2020-012 and Temporary FAIN # 1167-2021-7.

Activities to be Performed

Specifically, this ARP Capital Investments grant partially supplants the amount of non-CIG funding for the following activities per the FTA scope activity line item as follows:

14.01.10 Guideway and Track Elements (all sections)
14.02.20 Stations Stops Terminals Intermodal (all sections)
14.03.30 Support Facilities: Yards Shops Admin. Buildings (all sections)
14.04.40 Sitework Special Conditions (all sections)
14.05.50 Systems (Sections 50.02 and 50.05)

Utah Transit Authority (UTA) agrees that it will amend the corresponding Small Starts construction grant (UT-2021-021) in TRAMS to reduce the local share for the FTA scope activity line items noted above.

Expected Outcomes

ARP funding will permit Utah Transit Authority (UTA) to continue to successfully deliver the Ogden/WSU Bus Rapid Transit Project.

Intended Beneficiaries

Populace of the UTA transit service area and local area commuters.

Pre-Award Authority

Certain project costs were approved under the Entry into Project Development Letter from FTA dated September 18, 2018, and a Letter of No Prejudice (LONP) dated January 11, 2021. All expenses were incurred after they became eligible under the above-listed pre-award authority. Design and project development activities began shortly after the Entry into Project Development Letter in the fall of 2018. Right of way acquisition began around September 2019. The Construction Management/General Contractor (CM/GC) request for proposals was issued on September 26, 2019. A contract selecting Stacy-Witbeck and authorizing pre-construction services was signed December 23, 2019. A notice to proceed for utilities was issued on December 16, 2020. The next notice to proceed, signed March 19, 2021, authorized items allowed in the LONP and established a guaranteed maximum price for the rest of the project. Pre-award authority for ARP Capital Investments funding is effective on January 20, 2020. Therefore, eligible expenses incurred on January 20, 2020, or later may be reimbursed with ARP Capital Investments funding.

***Special Conditions***

The recipient UTA agrees that if it receives federal funding from the Federal Emergency Management Agency (FEMA) or through a pass-through entity through the Robert T. Stafford Disaster Relief and Emergency Assistance Act, a different federal agency, or insurance proceeds for any portion of a project activity approved for FTA funding under this grant agreement, it will provide written notification to FTA and reimburse FTA for any federal share that duplicates funding provided by FEMA, another federal agency, or an insurance company.

UTA certifies that it and its subrecipients and contractors that are providers of public transportation have not furloughed any employees since March 27, 2020, the enactment date of the Coronavirus Aid, Relief, and Economic Security (CARES) Act.
