Grant Description
Description: This agreement provides funding for the operation of the Nebraska Department of Environment and Energy's continuing environmental programs while giving it greater flexibility to address its highest environmental priorities, improve environmental performance, achieve administrative savings and strengthen the partnership between NDEE and EPA.

This agreement funds state continuing environmental programs for air, water, land, and data quality.

The work being done is in line with the Clean Water Act, Clean Air Act and Safe Drinking Water Act.

Activities: The activities to be performed include: developing total maximum daily loads in accordance with 40 CFR 130.7.

Conducting technical or compliance assistance meetings/inspections/phone calls for wells in Nebraska.

Conducting Nebraska pretreatment program compliance inspections.

NDEE will audit state-lead RCRA facilities which have institutional controls (IC) in place and have not been audited in five years or more to assess knowledge of and compliance with the IC requirements.

The Nebraska Department of Environment and Energy (NDEE) will develop and implement a compliance and inspection plan consistent with the EPA's 2016 compliance monitoring strategy.

NDEE will conduct inspections at Title 5 and non-Title 5 sources consistent with the schedule outlined in the NE Continuous Monitoring System (CMS) plan for FFY 2025 through 2028.

NDEE will review and issue air permits.

NDEE will assume delegation and implement CAA Section 112 National Emission Standards for Hazardous Air Pollutants (NESHAP) standards.

NDEE will investigate all hazardous waste handlers found or suspected to be presenting an imminent threat to human health or the environment.

NDEE will perform regular inspections of potential hazardous waste generators.

Subrecipient: Activities will include air monitoring by City of Omaha Air Quality Control (OAQC), the Douglas County Health Department (DCHD) and the Lincoln-Lancaster County Health Department (LLCHD).

These local agencies will carry out portions of the air program within their local jurisdictions.

The direct output will be the negotiated workplan between NDEE and these local air monitoring agencies.

The outcome will be coordinated implementation efforts.

Outcomes: The anticipated deliverables include: NDEE will enter all required data elements into RCRAInfo; air monitoring inspections will be completed, and inspection reports submitted to EPA; Class 1 and new source review air permits will be issued; executing the NESHAP implementation strategy; NDEE will provide the number of complaints received related to generator management of hazardous waste and number of complaints resolved; NDEE will provide EPA with a number of formal and informal enforcement actions.

The expected outcomes from this agreement are: institutional control audit findings will be made available to EPA electronically through the public records portal; cleaner air, water and soil in the state of Nebraska; improved compliance with air quality regulations; effective enforcement program implementation.

Direct beneficiaries of this program are the citizens of Nebraska and the general public.

It benefits human health and the environment.
