Description:
This agreement funds the recipient's program to conduct remedial action at the Upper Ten Mile Site, which is listed on the National Priorities List (NPL) of the National Oil and Hazardous Substances Contingency Plan. This cooperative agreement will support MDEQ-LEAD site-specific activities at the Upper Ten Mile Creek Mining Area (10 Mile) site in Montana through December 31, 2024. Activities proposed for funding in this CA application include contracted services for DEQ-LEAD remedial action activities at Upper 10 Mile site, specifically for remedial action at Minnehaha/Landmark/RV Ranch and remedial action engineering services. These remedial action activities may be extended into a second construction season (2024) if needed.

Activities:
The activities to be performed include the following site-specific actions. MDEQ, under this CA, will provide interagency coordination and contracted remedial action work and remedial action engineering services. Below are commitments for the Minnehaha/Landmark/RV Ranch remedial action.

Intergovernmental Agency Agreement Coordination/Contracted Services Management:
Commitment 1 - Define technical expertise requirements
Commitment 2 - Prepare and administer intergovernmental agency agreements
Commitment 3 - Review and comment on documents
Commitment 4 - Procure and manage contractor services

Site-Specific Work Plans for Remedial Action:
10 Mile Remedial Action
Work Scope
MDEQ will issue a remedial action construction contract to complete the following work:
- Preparing pre-construction submittals prior to construction activities for all work covered by contract documents.
- Installing and maintaining erosion and site controls for all aspects of the project.
- Performing dust control and road maintenance.
- Clearing and grubbing project work areas.
- Improving access, as necessary, to mine sites to allow for remedial construction, including haul roads and bridges.
- Performing surveying, including construction grade staking, pre- and post-waste placement surveys, and as-built survey, for all project areas.
- Performing materials testing for project materials, including on construction materials (e.g. granular material) and compaction testing on placed materials.
- Performing necessary excavation at the solid media removal mine sites, waste stockpile, and RV Ranch irrigation ditches to remove contaminated soils. Excavated materials will be hauled to the Luttrell Repository for placement and disposal.
- Generation (screening/crushing) of backfill fill materials from existing stockpiled material at Basin Creek Mine, and backfill of excavation areas at solid media removal sites.
- Remove repository cover and place waste from the solid media removal sites, in addition to waste staged at the north end of the repository, into the repository. Replace winter cover after waste placement in the repository.
- Revegetation of all areas disturbed during construction, including growth media placement, seeding, and hydro-mulching, and installation of erosion control blankets, as necessary.
- This work also includes cleaning/repair/installation of culverts as necessary on the site or the access roads, as identified by the engineer.

Project Management for Construction Oversight of Minnehaha/Landmark/RV Ranch Remedial Action:
Work Scope
MDEQ will issue a remedial action engineering services (construction oversight) contract to complete the following work:

Task 1 - Construction management and construction oversight
Contractor shall provide management for construction including project management, design engineering, and administrative staff. Contractor shall provide the following office engineering services, including, but not limited to:
- Review construction contractor submittals for compliance with contract documents.
- Review construction contractor payment requests.
