Description:
This action approves funding in the amount of $1,770,000 to provide assistance to the Kentucky Energy and Environment Cabinet. Specifically, this agreement provides funding for its Leaking Underground Storage Tank (LUST) Corrective Action Program, which includes assessment, remediation, and enforcement related activities. The main objectives of the LUST Corrective Program are to investigate suspected petroleum releases and to perform corrective action on these releases.
Activities:
Major activities include investigating suspected petroleum releases, overseeing and enforcing corrective action by owners or operators, and performing direct corrective action activities when those owners or operators are unknown, unwilling, or unable to perform those activities themselves. Activities/outputs performed include but are not limited to implementing corrective actions to determine source and extent of contamination at Underground Storage Tank (UST) sites. Another activity is to recover costs from responsible parties (RP's) who are unwilling to pay for the cleanups. Investigative reports are reviewed to determine the necessity for additional investigation and cleanup. The recipient will work towards reducing its backlog of leaking underground storage tank cleanups by 75, which will lead to the protection of the environment and subsequently the public.

Outcomes:
The anticipated deliverable is the state cleanup data that is entered into the LUST4 system. The primary outcome is a reduction in the backlog of UST releases for which cleanups have not yet been completed. The primary beneficiary is the state corrective action program. Expected outcomes/results include but are not limited to controlling the risks to human health and the environment at contaminated sites by mitigating the impacts of accidental or intentional releases, and by cleaning up, stabilizing or other action, and restoring contaminated sites to appropriate levels to make land ready for reuse.
