What is Personal Services?

• Definition [FAR 37.104]:
“A personal services contract is characterized by the employer-employee
relationship it creates between the Government and the contractor’s
personnel.”
• Authority [DFARS 237.104(b)(ii)]: May be used for health care as

authorized by 10 U.S.C. 1091.

• RFP Reference [PWS, paragraph 1.5.1.1]:
“contract worker…subject to day-to-day supervision and control by
Government personnel.”

What is Non-Personal Services?

• Definition [FAR 37.101]:
“a contract under which the personnel rendering the services are not
subject, either by the contract’s terms or by the manner of its
administration, to the supervision and control usually prevailing in
relationships between the Government and its employees.”
• RFP Reference [PWS, paragraph 1.5.1.2]:
“the Government shall neither supervise contract employees nor control
the method by which the Contractor performs the required tasks”. This
includes work schedules
