Summary
This Justification and Approval (J&A) for the use of other than full and open competition is issued by the Naval Surface Warfare Center Indian Head Division (NSWC IHD).
The J&A outlines the intent to award a follow-on sole-source contract to Applied Energetic Technology Corp (AETC) for the procurement of 1,100 CCU-189/B Impulse Cartridges (DODIC JP40) specifically designed for use in EA-18G aircraft.
The cartridges are required to be HERO-Safe, meaning they have been modified to prevent hazards associated with electromagnetic radiation, thus allowing aircraft operations without an At-Risk status. The total estimated value of this contract is approximately $750,000, with a delivery deadline set for the end of calendar year 2026.
The justification for this sole-source procurement is based on statutory authority under 10 U.S.C. 3204(a)(1), which allows for contracts when only one responsible source can meet the agency's requirements. AETC is identified as the only source capable of producing these specialized cartridges that meet all necessary government performance and safety standards within the required timeframe.
NSWC IHD currently has no plans to seek competition for future contracts related to these supplies but will reassess if new potential sources become available. Additionally, it confirms that the anticipated costs associated with this procurement have been determined to be fair and reasonable.
