Notice of Intent to Sole Source

Very Small Aperture Terminal (VSAT)/ Marine Corps Wideband Satellite Communications Expeditionary (MCWS-X) Software Maintenance and Technical Support

The Marine Corps Systems Command (MARCORSYSCOM) intends to negotiate and award a new contract on a sole source basis in accordance with FAR 6.302-1, with the incumbent, Viasat, Inc. 6155 El Camino Real Carlsbad, CA 92009-1602. Software Maintenance Support and Technical Support is required for the current fielded VSAT systems and MCWS-X systems. This requirement entails:

  • LinkWay S2/S, MD-1366 Enhanced Bandwidth Efficient Modem (EBEM), CBM-400/e (with eNCC software), and CBM-400 (with LinkWay and EBEM waveform) software and firmware, and Security Shield software that are part of the current install base and includes the following:
    • Software/firmware patches, upgrades, and bug fixes through the latest software/firmware released.
  • Information Assurance (IA) software updates required to mitigate Defense Information Systems Agency (DISA) Field Security Office Category I and Category II, Security Technical Implementation Guide (STIG), Nessus Vulnerability Scan findings to the extent possible for the currently deployed hardware and software;
  • Creating and delivering associated license key files and PKI certificates; and,
  • Providing technical assistance 24 hours x 7 days a week x 365 days via telephone or email from a Network Operations Center (NOC) in response to any request for support of LinkWay S2/S, MD-1366 EBEM, CBM-400/e, and CBM-400 products.

The Government anticipates award of an indefinite delivery, indefinite quantity Firm-Fixed-Price contract, with a period of performance of five years. The proposed acquisition will be awarded to Viasat, Inc. pursuant to 10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii). Only Viasat, Inc., the original equipment manufacturer and sole producer of the LinkWay and EBEM product, has the requisite corporate knowledge, technical expertise, and facilities necessary to satisfy the Marine Corps requirement.

This is not a request for competitive quotes. No formal solicitation package is available. The Government will not be responsible for any cost incurred in responding to this notice.
