Description

The notice is for informational purposes only IAW FAR 5.203(a).

United States Special Operations Command (USSOCOM) intends to solicit and negotiate an Indefinite-Delivery/Indefinite-Quantity (IDIQ) contract on a sole source basis under the authority of FAR 6.302-1 with ViaSat Inc., 6155 El Camino Real, Carlsbad, CA 92009-1602 for the continued procurement of ViaSat equipment, and the associated software and sustainment services. This contract will be for the procurement of the following primary mission equipment (PME); HHL-16 Radios, Digital Aided Close Air Support-Gateway-SOF (DACAS-G-S) kits, Small Tactical Terminals (STT), Flex In-Vehicle Equipment (F-IVE), Portable Antennas, SDN Commercial Broadband Modems (CBM) 400 software-defined modem with MIL-STD-188-165B/STANAG 4486 ed.3 (Enhanced Bandwidth Efficient Modem (EBEM)) waveform and Viasat proprietary Arclight, Linkway, and High Capacity Ka (HCKa) waveforms, Ku Spread Spectrum ArcLight2 Ground (M, Ku Spread Spectrum ArcLight2 Ground (Multi-Beam) Hubs, KG-250X and KG-255 High Assurance Internet Protocol Encryptor (HAIPE) Devices (when authorized to purchase locally by the National Security Agency (NSA), and associated ancillary items. Additionally, the scope includes the procurement of Dynamic Defense portal licenses, the required sustainment and support services, and training for this PME in support of PEO C4 Tactical Communications Systems.

The IDIQ contract is anticipated to have five, one year ordering periods starting on approximately 21 Nov 2022 through 20 Nov 2027. The contract minimum guarantee will be $5K with a maximum ceiling value still being finalized, however currently estimated to be approximately $325M.

As outlined the attached draft Justification and Approval (JNA), a determination not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 6.302-1, only one source capable of satisfying the agency's requirements. All the equipment to be included on this contract results from a previous contract (H92222-18-D-0005, H92222-12-D-0022, H92222-13-D-0012, H92222-14-D-0062), which were for the development and integration of and/or the production and sustainment of each product. ViaSat Inc. is the sole Original Equipment Manufacturer (OEM) of this PME and all associated ancillaries. As such, the hardware, software, and associated technical data necessary for production and to provide the related sustainment and support services are proprietary to ViaSat.

Per FAR 5.207(c)(16)(ii), all responsible sources may submit capability statements that will be considered by the agency. Any party responding to this notice shall send clear, factual documentation demonstrating their ability to execute this PEO C-4 Tactical Communications Systems Network requirement.

NOTE: Capability statements must also demonstrate the ability to provide alternate capabilities that not only meets all the key capabilities of the ViaSat equipment listed above and possesses the required certifications, but also offers increased capabilities that outweigh the substantial duplication of cost to the Government and significant delays in fulfilling USSOCOM mission requirements that would be associated with introducing alternate capabilities at this time on a competitive basis.
