A Memorandum of Understanding (MOU) was established between the US Corps of Engineers, Sacramento District and the Sutter County Museum to develop an interpretive Native Plant Garden. The garden will serve as mitigation under Section 106 of the National Historic Preservation Act, to resolve adverse effects to significant cultural resources caused by the District's Sutter Basin Flood Risk Management Project in Sutter County. The mitigation was agreed to through consultation among the District, the United Auburn Indian Community, the California State Historic Preservation Officer, the museum, and the Enterprise Rancheria Estom Yumeka Maidu Tribe. A determination by the Government not to compete this proposed requirement is based upon the fact that Enterprise Rancheria, Estom Yumeka Maidu Tribe, a federally recognized Indian Tribe, has the experience for a landscape plan using plant species native to the Sacramento Valley. Enterprise Rancheria possesses the inherent expertise, ancestral, and cultural relevance and ties to the Sutter Basin Project area necessary to develop the interpretive materials for the public and tribal visitors to the garden. These unique requirements are necessary to ensure the Garden meets the purpose and need of the required mitigation, which were established through USACE tribal consultation and specifically developed for the Programmatic Agreement.
