State Tobacco Retail Compliance Inspections for “ONLY” 8 US States (CA, IL, MI, MN, NJ, PA, WA, and WI) and the territories of American Samoa and Northern Mariana Islands

Background
The Food and Drug Administration (FDA) is issuing a Request for Proposal (RFP) to assist in inspecting retail establishments that sell cigarettes and/or smokeless tobacco products, as well as surveilling other entities under the Tobacco Control Act.

This solicitation is specifically targeted at agencies or subdivisions of state, territory, or local governments in eight U.S. states (California, Illinois, Michigan, Minnesota, New Jersey, Pennsylvania, Washington, Wisconsin) and the territories of American Samoa and Northern Mariana Islands.

The goal of this contract is to enforce compliance with federal laws regarding tobacco sales to protect public health and reduce youth tobacco use.

Work Details
The contractor will be responsible for conducting compliance check inspections of tobacco retailers to ensure adherence to the Tobacco Control Act and related regulations.

Key tasks include:
1. Conducting inspections of retailers selling regulated tobacco products and documenting compliance results.
2. Collecting and preserving evidence from inspections.
3. Supporting FDA in enforcement actions by coordinating declarations from inspectors and arranging testimonies if necessary.
4. Responding to inquiries from FDA regarding inspection data.
5. Training contractors and subcontractors involved in inspections.
6. Managing program tasks including communication with FDA, quality control plans, and maintaining records of inspections.
7. Ensuring all personnel involved are properly commissioned by the FDA and undergo necessary background checks.

Period of Performance
The contract will have a period of performance spanning five years with task orders issued for specific periods within this timeframe.

Place of Performance
The contract will be performed in specified U.S. states (California, Illinois, Michigan, Minnesota, New Jersey, Pennsylvania, Washington, Wisconsin) and the territories of American Samoa and Northern Mariana Islands.
