Royalty Auditing Services

Background
The Navy Trademark Licensing Program Office (NTLPO) is responsible for registering trademarks, licensing commercial companies, conducting enforcement, and educating trademark users worldwide to protect and enhance the Navy brand in the commercial marketplace.

The goal of this contract is to promote a strong trademark licensing program by ensuring that all licensed products adhere to the requirements set in the Navy’s Trademark License Agreement. This includes conducting royalty audits to analyze licensee compliance with financial obligations.

Work Details
The contractor will conduct royalty audits on behalf of the NTLPO, requiring one audit for the base year and up to three audits per option year based on specific conditions.

Key tasks include:
1. Pre-Fieldwork: Obtain five years of sales documentation from the Licensee and historical sales data from NTLPO.
2. Fieldwork: Examine sales documentation to identify unreported royalties, incorrect rates, unapproved products, and other discrepancies.
3. Post-Fieldwork: Provide findings to NTLPO for review and determine owed amounts based on historical reporting.
4. Meetings: Conduct meetings as requested for settlement discussions.

The contractor must ensure comprehensive records are maintained at the Licensee's location and may need to travel for fieldwork.

Period of Performance
The contract will be performed over a period of one twelve-month base year with four additional twelve-month option periods.

Place of Performance
Most work will be performed electronically; however, onsite visits at the Licensee’s place of business within the continental United States (CONUS) may be necessary.
