Description

This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source firm fixed price contract to the following contractor in support of needed Radiopharmaceutical Products for the Fargo VA Healthcare System 2101 North Elm Street, Fargo, ND 58102 and Sioux Falls VA Health Care System 2501 W. 22nd Street, Sioux Falls, SD 57105:

This is done under authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1: Only one source and no other supplies or services will satisfy agency requirements.

This is not a request for competitive quotes.

Market research revealed that Cardinal Health 414, LLC is the only company that is able to maintain and support the needed Radiopharmaceutical Products at the Fargo VAHCS and Sioux Falls VAHCS.

Additionally, Cardinal Health 414, LLC has a radiopharmaceutical pharmacy in South Dakota and Minnesota capable of providing these items in accordance with the stringent delivery requirements.

The North American Industry Classification System (NAICS) code for this service is 325412 (Pharmaceutical Preparation Manufacturing) and the Product Service Code (PSC) is 6505 (Drugs and Biologicals).

While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement, including documentation from the proprietary rights holder Cardinal Health 414, LLC that such contractor could provide this service as an authorized reseller, authorized dealer or third party.

Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government under authorities cited above.

Background
The Fargo VA Healthcare System and Sioux Falls VA Health Care System are seeking a contractor to provide Radiopharmaceutical Products. The contract is awarded to Cardinal Health 414, LLC, which is the only company capable of maintaining and supporting these products at the specified healthcare systems. Cardinal Health has a radiopharmaceutical pharmacy located in South Dakota and Minnesota that meets stringent delivery requirements. This contract is issued under the authority of 41 U.S.C. 3304(a)(1), indicating that only one source can fulfill the agency's needs.

Work Details
The contractor shall provide Radiopharmaceutical products for use at the Sioux Falls VAHCS & Fargo VAHCS Nuclear Medicine Diagnostic Imaging Service. All orders must be delivered in Unit Dose (UD) amounts, which may include inhalable, ingestible, or injectable forms as specified in the Price/Cost Schedule. The estimated quantities listed are contingent upon patient volume and required procedures. The contractor must ensure compliance with all applicable laws and regulations, including those from the Nuclear Regulatory Commission (NRC) and Department of Transportation (DOT). Quality control measures must be implemented for all radiopharmaceuticals provided under this contract, including documentation of quality control results upon request. The contractor will also provide emergency on-call services and maintain records of inventory, disposal, and patient dose compliance with NRC requirements.
