PROJECT LABOR AGREEMENT INQUIRY FOR FY18 P-169, WAIAWA WATER TRANSMISSION MAIN REPLACEMENT, PEARL CITY, HAWAII   3

This is a Project Labor Agreement survey only. This is not a request for proposal, request for quote, or invitation for bid. There will not be a solicitation, specification, or drawings available at this time. NAVFAC Pacific is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for the titled project above. Project Description: This project proposes to construct a new primary potable water transmission line from the Waiawa Pump Station to an existing water line at the intersection of Lehua Avenue and Second Street (Pearl City Junction) and a secondary line to the Manana Housing booster pump station to replace the deteriorated existing pipeline. This is a design/bid/build project. NAICS Code: 237110 Water and Sewer Line and Related Structures Construction. The magnitude of construction for this project is anticipated to be between $25,000,000 and $100,000,000. Prime Contractors must self-perform at least 20% of the work. The period of performance is anticipated to be approximately 900 calendar days. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158 (f). Federal Acquisition Regulation (FAR) Policy states: Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) be consistent with law. Reference is made to provision, FAR 52.222-33 Notice of Requirement for Project Labor Agreement, and to clause, FAR 52.222-34 Project Labor Agreement. In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs for this project. Of particular interest to the Government are responses to the following questions: 1. Have PLAs been used on comparable projects undertaken by the public or private sector in Hawaii? If so, please provide supporting documentation. 2. Does the local market have sufficient number of available skilled workers for this project? Are there other projects in the vicinity that will limit the pool of skill labor available for this project? Please elaborate and provide supporting documentation. 3. Are you aware of any past or current labor strikes or disputes that may impact this project? If so, please elaborate and provide supporting documentation. 4. Which Collective Bargaining Agreements will expire during the course of the project that may cause delays? 5. Could a PLA contribute to cost savings in any of the following: a. Harmonization of shifts and holidays between the trades to cut labor costs? b. Minimizing disruptions that may arise due to expiration of Collective Bargaining Agreements? c. Allowing for changes in apprentice-to-journeyman ratio? d. Serving as a management tool that ensures highly skilled workers from multiple trades are coordinated in the most efficient way? 6. Could a PLA minimize risk and contribute to greater efficiency in any of the following ways: a. Mechanisms to avoid delays? b. Compliance with Construction Wage Rate Requirements and other labor standards, safety rules, EEO and OFCCP laws? c. Ensuring a steady supply of skilled labor in markets with low supply or high competition for workers? 7. Identify specific reasons why you do not believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement. 8. Could a PLA increase costs on this project? If so, please elaborate and provide supporting documentation (if any). This is not an announcement of the availability of a solicitation nor is it a means of generating a plan holders TM list. After review of the responses to this synopsis, a pre-solicitation announcement will be published in the Federal Business Opportunities (FedBizOps) if the Government intends to proceed with the procurement of this project. The Government will not contact the responders for clarification of information provided. This survey is for planning purposes only and shall not be construed as a Request for Proposal or as an obligation on the part of the Government. The Government does not intend to award a contract on the basis of this market survey or otherwise pay for the requested information. The Government will not provide a debriefing on the results of this survey. All information will be held in a confidential manner and will only be used for the purposes intended. The construction community is invited to answer and comment on the use of a PLA for the above titled project.
