As previously noted in the answers to supplemental questions, Amendment No. 03 revises the page limitation referenced in Section L.8 and L.8.4 from 60 pages to 68 pages.
Amendment No. 03 also revises Section B.2 to provide prime contractors the flexibility to issue T&M and L-H subcontracts for a limited period of time, responding to concerns raised by a few prospective offerors about the need to engage with certain commercial firms.
After one year, the IDIQ CO will determine whether to allow IDIQ prime contractors to continue to use such subcontract types after evaluating their performance during that year. (Note that per the terms of the amendment a contractor could issue a two year T&M subcontract in year 1; therefore, the period of performance of that T&M subcontract executed in Year 1 is not limited to that one year.)
USAID believes that this provision equitably meets the interests of the contractor community and the Government (which has real concerns with contract types that can ultimately prove disadvantageous to the buyer).
