The Federal Bureau of Investigation (FBI) intends to award a sole source purchase order to Pen-Link, Ltd. 5944 Vandervoort Drive, Lincoln, NE 68516 for Pen-Link PLX Software. This solicitation document and incorporated provisions and clauses in effect through Federal Acquisition Circular 2021-04, the North American Industry Classification System (NAICS) is 511210 with a business size standard of $41,500,000. A quote is being requested under solicitation no. DJF-21-0600-PR-0002792. This will be a fixed price contract for 12 months. Based on FBI market research, it has been determined that Pen-Link, Ltd. is the only source to meet the FBI requirement and no other supplies or services will satisfy the agency requirements. Pen-Link, Ltd. does not have any authorized resellers capable of providing PLX Software. The proposed contract action is for software licenses for which the Government intends to solicit and negotiate with only one source under the authority of TLE 41,usc 3304 (a)(1). This notice is not a request for competitive proposals. Interested parties may identify their interest and capability to respond by submitting a proposal to include technical qualifications and experience/pricing and any other information to Christina Nortey, Contracting Specialist at cnnortey@fbi.gov. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commercial Items (JUN 2020): FAR clause 52.212-2, Evaluation Commercial Item (OCT 2014), FAR clause 52.212-4 Contract Terms and Conditions Items (OCT 2018); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (JAN 2021). Each offeror shall include a complete copy of the clause 52.212-3 Offeror Representations and Certifications - Commercial Item (JAN 2021). A determination by the Government not to compete this proposed requirement is based upon responses to this notice and is solely within the discretion of the Government.
