The purpose of this amendment 0002 is to: 1. Update the Contract Specialist from TBD to Christy Hughes throughout the RFP; and 2. Answer the following question: Will CMS confirm that should it conclude that an offeror has provided insufficient information in response to Contractor Integrity/Misconduct' Section of Attachment J.10, CMS will provide that offeror with the opportunity to submit additional information as identified by CMS? Response: As to conflicts of interest, FAR 9.504(e) will be followed. As stated in FAR
3.1002(a) Government contractors must conduct themselves with the highest degree of integrity and honesty and according to 9.104-1(d), to be determined responsible, a prospective contractor must have a satisfactory record of integrity and business ethics. The information requested under contractor integrity/misconduct helps CMS ensure
the requirements of 3.1002(a) and 9.104-1(d) are being met. For the J6 acquisition, in making a responsibility determination, CMS will review the information provided by the offeror in J.x as well as any other information that may be available. If the CO has questions or believes additional information is necessary from the offeror on matters involving business ethics and/or record of integrity, the CO will notify the offeror and request that information be provided. Such communications are considered to be an "exchange" with an offeror and, based on GAO decisions, such exchanges would not
constitute discussions and thus do not trigger the requirement to hold discussions with other offerors.
