Outward Mindset Program Training

DESCRIPTION

THIS IS A NOTICE OF INTENT TO SOLE SOURCE AND NOT A REQUEST FOR QUOTATION, REQUEST FOR PROPOSAL, OR INVITATION FOR BIDS.

The Nation Oceanic and Atmospheric Administration (NOAA) National Weather Service (NWS), located in Silver Spring, Maryland, intends to negotiate on a sole source basis and award a Firm-Fixed-Price call order to Arbinger Company, (686 N Arbinger Way Suite 200 Farmington, UT 84025, SAM Unique Entity ID: XDJYKQ4BVTJ3). The Arbinger Company, (doing business as The Arbinger Institute, LLC), is a registered small business. The Arbinger Company is the sole owner and provider of its Outward Mindset series of training programs.

This requirement consists of Outward Mindset off-the-shelf training encompassing;

1. In-person training courses (10 courses in total),
2. In-person or virtual individualized coaching sessions (12 in total),
3. Virtual strategic working sessions (3 in total, either 1/2 or full day),
4. Virtual application sessions (16 in total, approximately 90 minutes each), and
5. On-line course materials and workbooks.

In accordance with Federal Acquisition Regulation (FAR) Part 8.405-6(a)(1)(i)(B), Limiting Sources,' this training is peculiar to one manufacturer.

The Arbinger Company holds exclusive proprietary rights to the Outward Mindset Program course materials and digital products. These materials are specifically designed with unique elements that cannot be reproduced by any other provider, establishing The Arbinger Company as the exclusive source for this particular training program. The products offered by Arbinger have been determined to be the only product to meet the Government's minimum requirements to address the training from an outward mindset. The resulting purchase order will provide training, facilitation, coaching, and digital materials to the NWS staff. The digital media supplements the commercial-off-the-shelf Arbinger training that is available on their General Services Administration (GSA) schedule.

APPLICABILITY OF AUTHORITY:

The purchase order will be awarded using a GSA schedule in accordance with FAR 8.404(a), Use of Federal Supply Schedules' in compliance with 41 U.S.C. 1901 that governs 'Simplified Acquisition Procedures.' The following FAR parts are not applicable when placing purchase orders against Federal Supply Schedules: FAR Part 6 Competition Requirements', FAR 13 Simplified Acquisition Procedures,' FAR 14 Sealed Bidding,' FAR 15 Contracting by Negotiation,' and FAR 19 Small Business Programs.'

There is no anticipated subcontracting opportunity. This procurement falls under the North American Industry Classification System (NAICS) code 611430, which is categorized as 'Professional and Management Development Training,' and has a standard business size classification of up to $15 million in annual revenue.

NOAA NWS will solicit and negotiate directly with Arbinger and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations. However, if an interested party believes that it can meet the above requirement, it may submit a capability statement which shall be considered by the agency. The statement must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement and is an authorized reseller of the Outward Mindset Program. Respondents must have an active registration in the System for Award Management (SAM) at www.sam.gov.

Only one source is capable of providing the supplies or services required. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. All interested parties must express their interest in writing via email to timothy.wampler@noaa.gov by 12:00 pm Eastern time Tuesday, June, 27, 2023. No faxed documents will be accepted. If no responsive statements are received within the stated time, an award will be made to Arbinger Company. The anticipated award date is July 19, 2023.
