OEDIB Upgrade and Migration

The United States Patent and Trademark Office (USPTO) had an upgrade and migration to the existing Automated Information System (AIS) using Questionmark Perception to Questionmark OnPremise. The USPTO negotiated and awarded a purchase order for the Questionmark OnPremise Software, NAICS 541519 Other Computer Related Services to Questionmark Corporation for a period of five (5) years with a value of $172,707.21. The award was made on July 31, 2019.

Market research revealed that Questionmark Corporation is the only available source for the Questionmark OnPremise Software and that Questionmark Corporation does not have any Small Business resellers. Questionmark Corporation is the creator of the proprietary content and technology contained therein. This requirement is essential to the USPTO daily duties. The USPTO has confirmed that the product is FedRAMP Compliant.

As a result of the market research and the USPTO's exemption from the Competition in Contracting Act, the subject requirement was procured using the Federal Acquisition Regulation Part 12 (Acquisition of Commercial Items) and 13 (Simplified Acquisition Procedures).
