Notice of Intent to Sole Source

Space Systems Command, on behalf of the Program Executive Officer for Military Communications and Positioning, Navigation, and Narrowband SATCOM Acquisition Delta Program Office (CGN) in San Diego, CA intends to award a sole-source contract with General Dynamics Mission Systems (GD-MS) located at 8201 East McDowell Road, Scottsdale, AZ 85257, for sustainment and modernization support for the MUOS Ground System. GD-MS shall provide all services required for the sustainment, modernization and maintenance of the MUOS Ground System including all hardware and software improvements, modification kits, waveform modifications, updates, supply support, training support, development, modernization, digitization, integration, testing, and site support.

Market research conducted to date by the Government has included the posting of a Sources Sought Request for Information (RFI) on 19 May 2022 and a comprehensive analysis of the responses received. The results of this market research indicate that a sole source award to GD-MS is justified in accordance with 10 U.S.C. 2304(d)(1)(B), as implemented by FAR 6.302-1(a)(2)(ii) because it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency's requirements. The planned contract is anticipated to be awarded in October 2024 and will be an Indefinite Delivery, Indefinite Quantity (IDIQ) contract. The contract will consist of a five-year base ordering period and a single five-year option ordering period and will include a mix of fixed price and cost reimbursement Contract Line Item Numbers (CLINs).

This notice of intent is not a request for competitive proposals and no solicitation document will be issued. However, all responsible sources interested in responding to this notice may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Any capability statement, proposal or quotation shall include the following information: 1) the business' demographic information showing responsibility in accordance with FAR Part 9; 2) specific exception to the intent to procure on a sole source basis; 3) technical data showing the capabilities of the respondent to perform the work listed above. The capability statement, proposal or quotation must provide clear and unambiguous evidence to substantiate the capability of the party to provide the required services as listed above.

A request for documentation or additional information or submissions that only ask questions will not be considered an affirmative response to this notice. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will not be paid for by the Government and will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source procurement. Capability statements, proposals or quotations are due on Friday, 30 June 2023 by 11:00 AM Pacific Time. It is the responsibility of the respondent to contact the Government to confirm receipt prior to the above due date and time.
