NOTICE OF AWARD OF A SOLE SOURCE CONTRACT.

Under the authority of FAR 6.302-1, 41 U.S.C. 3304(a)(1), the Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Western Acquisition Division (WAD) in support of the National Weather Service (NWS), Office of Water Prediction (OWP) awarded a sole source, hybrid Firm- Fixed Price (FFP) and Time-and-Materials (T&M) contract to Deltares USA (hereafter referred to as Deltares).

The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Western Acquisition Division (WAD) in support of the National Weather Service (NWS), Office of Water Prediction (OWP) have a requirement to provide IT services through the support and maintenance of NWS/OWP's Community Hydrologic Prediction System (CHPS) Infrastructure through conducting stable builds, enhancements, patches, and evaluation boards of the Delft Flood Early Warning System (Delft-FEWS) software system. Delft-FEWS is a collection of modules designed for building a hydrological forecasting system customized to the specific requirements of an individual organization including NWS's 13 river forecast centers (RFCs), and provides a state of the art hydrological forecast and warning system.

Only one responsible source and no other supplies or services will satisfy agency requirements in accordance with FAR 6.302-1. IT services conducted by Deltares USA Inc. are required (due to compatibility to Delft-FEWS software) to support and maintain NWS/OWP's Community Hydrologic Prediction System (CHPS) Infrastructure through conducting stable builds, enhancements, patches, and evaluation boards of the Delft Flood Early Warning System (Delft-FEWS) software system.

Deltares Netherlands solely authorizes Deltares USA, Inc. in the US to license, distribute, and modify its existing software. The software is proprietary, and only Deltares USA, Inc. has the exclusive rights, licensing, and experience to alter the code. Furthermore, by nature of their proprietary level of knowledge, they are uniquely qualified to provide critical daily operational support and the other necessary services to ensure continuity of operations. Therefore, due to its unique and highly specialized nature, Delft-FEWS provided by Deltares USA, Inc is the only software that can meet the needs of NWS's flood forecasting mission.

A determination not to compete this proposed contract was based on market research and is solely within the discretion of the government. As evidenced in the sole source justification, there is only one contractor that could provide IT required for this contract without unacceptable delays. Proposals ARE NOT being requested and a written solicitation WILL NOT be issued.
