Missile Defense Agency (MDA) Presolicitation Notice to Support Terminal High Altitude Area Defense (THAAD) Configuration 3.1 Modernization Hardware Procurement   2

This Notice of the Intent to Sole Source and pre-solicitation notice is posted in accordance with FAR 5.201.

This is a notice of intent to solicit and negotiate a contract modification using Other than Full and Open Competition. The Missile Defense Agency (MDA) intends to solicit, negotiate and award a sole source contract modification to Lockheed Martin Missiles and Fire Control (LMMFC) for the production and delivery of Terminal High Altitude Area Defense (THAAD) Weapons System Configuration 3.1 Modernization hardware to support U.S. government requirements.

An acquisition strategy has been approved to solicit and negotiate with LMMFC under the authority of 10 USC 3204(a)(1) as implemented by FAR 6.302-1(a)(2)(ii), only one responsible source and no other supplies or services will satisfy agency requirements. LMMFC is the prime contractor (provider and integrator) for the THAAD Weapon System. LMMFC was under contract initially for system development, and is currently under contract for manufacturing and production. No other source possesses the extensive knowledge, experience, facilities and/or equipment to meet the Government need at this time.

Any information received as a result of this notice will be considered solely for enhancing competition in a future competitive procurement. The Government will not pay for information submitted. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All responses must be received no later than 10 a.m. Central Standard Time on November 1, 2023, and should be submitted to Ms. Ashley Kennemer, Contracting Officer, via email ashley.i.kennemer@mda.mil.
