Amendment 0002 is issued

  1. To answer the following submitted questions:

Question 1: Is incineration (or other thermal treatment) required for all waste streams under this contract, regardless of Base CLIN category (e.g., CS, FL, NR, PC, PF, RX, TX), or are alternative disposal methods permitted for certain non-RCRA, non-TSCA, or state-regulated wastes when incineration is not mandated by regulation or Universal Treatment Standards?

Specifically:
The PWS states the contract consists of removal, transportation, incineration or other thermal treatment, and final disposal (Section 0.0.a).
However, some CLINs appear to cover non-RCRA/state-regulated wastes (NR series) or materials where landfill or recycling may be allowable.
Section 2.4 allows for energy recovery (e.g., cement kilns), which may not constitute traditional incineration.

We want to confirm whether:
1. All turned-in waste must go to an RCRA-permitted incinerator, or
2. Alternative final disposition (e.g., permitted landfill, fuel blending, recycling) is acceptable when supported by the waste profile, regulatory status, and TSDF acceptance, provided full audit trail and compliance are maintained.

Answer 1:

Incineration (or other thermal treatment) is required for all waste streams under this contract. Final disposal must occur at a RCRA permitted TSDF appearing in the DLA QFL.

Fuels blending for destruction at cement kilns constitutes thermal treatment and can be considered energy recovery at the same time.

Question 2: Referencing Attachment 6, Addenda to 52.212-2, is it correct that the Subcontracting Plan will be evaluated on a "go-no go" basis?

Answer 2: Please see Attachment 6 Addenda to 52.212-2 Evaluation, Small Business Subcontracting Plans Evaluation, which outlines the evaluation process. This attachment also refers to FAR 52.219-9 and DFARS 252.219-7003, where you can find further information.

Question 3: Please confirm the information required for Volume III. Are the Small Business Participation Plan and separate Small Business Subcontracting Plan both required? The PROPOSAL SUBMISSION FORMAT AND CONTENT HAZARDOUS WASTE DISPOSAL SOLICITATIONS section lists Volume III as being required in subsection (b) but isn't included in subsection (c) MINIMUM CONTENT. Additionally, the SMALL BUSINESS PARTICIPATION PLAN AND SMALL BUSINESS SUBCONTRACTING PLANS section suggests both plans are required, but the additional information provided only requires a Small Business Subcontracting Plan.

Answer 3: Please see Attachment 5 - Addenda to 52.212-1 Instructions to Offerors, Small Business Subcontracting Plans, which outlines who is required to submit a Small Business Participation and Plan and Small Business Subcontracting Plan.

Question 4: With regard to the D009 waste code on several CLINs, Section 2.3 of the PWS states that the container will contain no more than 400 ppm or 0.04% mercury. Can you clarify if this is a weight-based level of mercury vs concentration. For example, if a drum weighs 500 lbs., the maximum amount of mercury in the drum would be 0.2 lbs.

Answer 4: The 400 ppm Hg referenced in PWS is weight-based.

  1. Extend the Solicitation response due date for one week from Monday, November 24, 2025, at 12:00PM EST, to Friday, December 05, 2025, at 12:00 PM EST.

Combined Synopsis/Solicitation SP450026R0002 has been prepared in accordance with the procedures in FAR 12.603(c)(2)(i xvi). Work on this effort will include the removal, transportation, incineration or other thermal treatment, and final disposal of containerized RCRA HW, non-RCRA wastes, polychlorinated biphenyl wastes, state and non-state regulated wastes generated by U.S. Department of Defense (DoD) and U.S. Coast Guard installations located in the 11 contiguous states of AR, IA, KS, LA, MN, MO, NE, ND, OK SD, and TX.

The following additional information is provided in accordance with FAR 12.603(c)(2).

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) Solicitation SP450026R0001 is issued as a Request for Proposal (RFP).

(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2025-06, effective October 01, 2025.

(iv) This acquisition is being issued as Full and Open under the associated NAICS code 562211; the Small Business size standard is $47M.

(v) See the attached Price Schedule.

(vi) See the solicitation for a description of the requirement.

(vii) The contract is anticipated to have a 30-month base period from March 2026 to September 2028 and a 30-month option period. See the solicitation for a list of pickup locations.

(viii) The provision at FAR 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. See the solicitation for addenda to the provision.

(ix) The provision at 52.212-2, Evaluation -- Commercial Items, applies to this acquisition. See the solicitation for addenda to the provision.

Background
The U.S. Department of Defense (DoD) and U.S. Coast Guard are seeking a contractor for the removal, transportation, incineration or other thermal treatment, and final disposal of hazardous and non-hazardous wastes generated by their installations across 11 contiguous states including Arkansas, Iowa, Kansas, Louisiana, Minnesota, Missouri, Nebraska, North Dakota, Oklahoma, South Dakota, and Texas.

This contract aims to ensure compliance with environmental regulations while effectively managing waste disposal.

Work Details
The contractor will be responsible for the following tasks:
1. **Removal Phases**:
- **Pre-Removal**: Includes criteria for Contract Line-Item Number (CLIN) selection, permit requirements, shipping/disposal documentation, notifications for site access, and security measures.
- **Removal**: Involves spill responsibility, segregation of hazardous waste, loading and weighing items for removal.
