INTRODUCTION
THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME).

This is not a request for a quotation. A solicitation document WILL NOT be issued and quotations will not be requested.

The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Center for Cellular Engineering (CCE), Clinical Center (CC) at the National Institutes of Health (NIH) intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to:

NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE
The intended procurement is classified under NAICS code 811219 with a Size Standard $22.0 mil.
REGULATORY AUTHORITY
The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2021-5, March 10, 2021. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold.
STATUTORY AUTHORITY
This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.

GENERAL INFORMATION

1. Title: Life Tech./ 4 years Services Agreement for QuantStudio 6 Pro and 3500xL Genetic Analyzer.

2. Background Information: The Department of Transfusion Medicine/Human Leukocyte Antigen Lab (HLA) has a need for continuation services for two crucial equipments, QuantStudio 6 Pro and 3500xL Genetic Analyzer. The service agreement is for two instruments that are used by the HLA Lab for daily testing of transplant patients and donors. The instruments are utilized to provide high resolution HLA typing results for multiple protocols at the NIH. Several of these protocols are for transplants. The vendor, Life Technologies., is the manufacturer of these instruments. It is the only company qualified to perform maintenance and service for their instruments. If maintained by any other vendor, it would invalidate the warranty and Life Technologies would not be held responsible nor liable for the instrument functionality nor for the patient test results which may not be accurate.

3. Objective: The service agreement is for two instruments that are used by the HLA Lab for daily testing of transplant patients and donors. The instruments are utilized to provide high resolution HLA typing results for multiple protocols at the NIH. Several of these protocols are for transplants.

4. There will be Base plus option for three additional years of coverage:

CONTRACTOR REQUIREMENTS (SCOPE OF WORK)

1. Service Requirements:

  • The AB Assurance Plan provides the following coverage:

Unlimited visits for emergency repair (includes travel, parts and labor)

One preventative maintenance visit per year per instrument

Priority scheduling for service requests

Telephonic and online support 24 x 7

Response Time: On-site two business day response time for repair services

  • The contract goes into effect 09/301/2021 and shall terminate 09/29/2022.
  • The contract includes all requirements for successful maintenance of each instrument.
  • The contract has the option to continue coverage for 3 additional years. Additional year pricing is stated in the Life Technologies Agreement referenced above.

2. Deliverables

  • Deliverables must be provided on the dates specified in the proposal with associated project management plan. Any changes to the delivery date must have prior approval (in writing) by the Project Manager or designate.
  • All deliverables must be submitted in a format approved by the customer/client contract official. At a minimum, the deliverable must be in an industry standard format - unless otherwise stipulated.
  • If the deliverable cannot be provided within the scheduled time frame, the service provider is required to contact the Project Manager in writing with a reason for the delay and the proposed revised schedule. The request for a revised schedule must include the impact on related tasks and the overall project.
  • A request for a revised schedule must be reviewed and approved by the Project Manager before placed in effect. Contract Terms and Conditions may dictate penalties, costs, and other actions based on the facts related to the request for a revised schedule.

CLOSING STATEMENT
This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.

A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
