This expert advice is required because of the frequent changes and updates in the local labor laws and regulations. Having a local legal counsel on retainer will be extremely helpful for post in dealing with the complexity of Vietnamese labor statutes.

The anticipate performance is for one base year period and continuing with two one-year option to renew.

This need arises from the frequent changes and updates in local labor laws, making it essential to have a local legal counsel on retainer to navigate the complexities of Vietnamese labor statutes effectively.

Work Details
The contractor will provide legal consultation services including:

- Conducting regular reviews and analyses of Vietnamese labor laws;
- Advising Embassy officials on compliance with policies and procedures;
- Providing consultative advice on sensitive personnel actions such as terminations and disciplinary actions;
- Offering legal guidance on conflicts between new policies from the Global Talent Management/Office of Overseas Employment (GTM/OE) and existing local laws;
- Advising on labor-related court decisions;
- Providing timely written updates on changes in labor legislation.

Key topics include Labor Contracts, Disciplinary Actions, Special Leave, Severance Pay, Menstrual Leave, Nursing Leave, Long Sick Leave, Leave without Pay, End of Services Benefits, and Workers’ Compensation. The contractor must have experience working with at least three diplomatic institutions or international NGOs on labor issues within the last five years. The contractor will also be responsible for providing written consultative advice within 14 calendar days when requested by the Contracting Officer's Representative (COR) regarding changes in regulations or discrepancies involving the U.S. Embassy.

Period of Performance
One base year plus two one-year options to renew, totaling a maximum of three years.

Place of Performance
Services will be performed at the U.S. Embassy in Hanoi, Vietnam.
