As outlined in the solicitation instructions (RFP pg 45), the Department is re-opening the solicitation in order to receive more proposals because it is in the best interest of the Department.

The U.S. Department of Energy (DOE), the Office of Headquarters Procurement Services in support of the Office of the General Counsel (OGC), is issuing Solicitation Number 89303025RGC000002 to procure professional legal and advisory services. This is a combined synopsis/solicitation for commercial items in accordance with Federal Acquisition Regulation (FAR) Subpart 12.6. The solicitation is conducted under FAR Part 15, Contracting by Negotiation, and constitutes the only solicitation for this requirement. This is in accordance with Federal Acquisition Circular 2025-06/08-27-2025.

This amendment provides notice to offerors about the task order ordering procedures under this IDIQ:

The Government reserves the right to make sole source task order awards under this IDIQ contract based on the specific area of legal specialty required for each assignment, without further competition among IDIQ holders. Task orders will be issued at the agency's discretion, taking into account the unique qualifications, expertise, and suitability of each contractor for the particular legal matter. In accordance with FAR 16.505(b)(2), the Government is drafting a class justification to support the award of sole source task orders without competition. Task orders meeting the criteria outlined in the class justification will be awarded on a sole source basis under this IDIQ, pursuant to the exception and justification provided. As such, the Government may select the most appropriate contractor for each task order on a sole source basis, rather than utilizing the fair opportunity process described under FAR 16.505(b)(1). This approach is intended to ensure that each legal requirement is addressed by the contractor best suited to the agency's needs, and not all IDIQ holders are guaranteed to receive task orders.

Offerors are hereby notified that the Government may not compete every new task order under this multiple award IDIQ. The Government reserves the right to make sole source task order awards based on the specific area of legal specialty or other agency needs, without further competition among IDIQ holders, in accordance with FAR 16.505(b)(2) and the class justification for highly specialized or unique work. Reasons for sole source task order awards may be based on: (a) only one IDIQ holder law firm is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized, or where conflicts preclude the ability of other IDIQ holder law firms to perform the work; (b) in the interest of efficiency and economy/logical follow-on, where new work is substantially similar to work previously performed by the IDIQ holder law firm under a prior task order or other award; (c) where the agency need for the work is so urgent that providing a fair opportunity would result in unacceptable delays, including distribution of work to ensure that no one IDIQ holder law firm is overwhelmed with multiple concurrent tasks and/or work surges.

Background
The U.S. Department of Energy (DOE), through its Office of Headquarters Procurement Services in support of the Office of the General Counsel (OGC), is issuing Solicitation Number 89303025RGC000002 to procure professional legal and advisory services.

This draft Request For Proposal (RFP) aims to establish an Indefinite Delivery Indefinite Quantity (IDIQ) contract for specialized legal services, particularly in energy law and litigation support. Work Details

The contract will have a five-year ordering period with no task order period exceeding one year after the expiration of the ordering period.

Place of Performance
Services will primarily be performed virtually from the contractor's facilities with minimal in-person requirements at DOE facilities.
