QUESTIONS AND ANSWERS Section 2.2-E: Second sentence regarding obsolescence Can we replace that sentence with the below? Obsolescence of Parts: In regards to Obsolescence of parts. If a part is available from the Original manufacturer or a third party vendor and we do not have to modify the existing equipment to accept the part and as long as it of the same design then it would be covered under the agreement. If however, we have to modify the equipment, engineer the part, custom manufacture the part or if that part is not readily available (shelf ready) then it would be considered obsolete and not covered. Our original language remains as Contractor shall provide tools, equipment, specialty items and other items that may be necessary to perform the tasks required under this Contract. Any parts not available from the manufacturer due to obsolescence remain the Contractor s responsibility to replace from another source. No reason to get into means and methods, modifying an elevator existing equipment build in most cases will not work anyway as they are specifically designed to operate a certain way. Are Overtime calls billable? Language is in the bid information and the PWS section 2.2
