4.43 Franchised/Licensed Distributor Traceability. Products that are not purchased directly from the Original Equipment Manufacturer (OEM)/Original Component Manufacturer (OCM) must be purchased only from a franchised/licensed distributor of the product being offered. The distributor must provide documentation that the distributor is contractually authorized by the manufacturer as a franchised / licensed distributor along with the geographic region(s) covered by the authorization. The distributor must not use brokers
(any company, person, or entity who is not an OEM/OCM or authorized by the OEM/OCM) for the purchase of items, unless pre-approval has been granted by Brookhaven Science Associates (BSA). For reference only, a list of authorized/franchised distributors for electronic components can be found at:

4.43.1 The distributor must ensure traceability of all products to the Original Equipment Manufacturer (OEM)/Original Component Manufacturer (OCM) by identifying the Original Equipment Manufacturer (OEM)/Original Component Manufacturer (OCM) for each lot and / or date code on the Certificate of Conformance. The distributor must provide a copy of the Manufacturer's certificate for the lot number being supplied, along with their franchised distributor documentation.

Freight along with any Packing & Handling fees are to be included in the all-inclusive price of the item delivered to BNL. *The BNL PO will NOT have a line for freight or extra fees.

2. Unique Entity Identifier (UEI)

Please also return the following along with your quote:

1. Published Price list: showing the items on your quote for price justification or a web screenshot (or link) of same/similar items with pricing and part number shown.

2. Insurance: **IF APPLICABLE** Upon award, in accordance with Article 6 of the attached BSA Supplemental Terms and Conditions for Work by Contractors On Site at Brookhaven National Laboratory . Prior to coming on site to perform work, the certificate must remain in effect for the duration of the subject contract and must be filed with BNL Procurement & Property Management Division.

3. System For Award Management (SAM):

In order to support DOE reporting requirements, BSA requires all its vendors/contractors to be registered in the U. S. Government supplier database entitled System For Award Management (SAM) with their Unique Entity ID number (UEI#). Registration can be performed on line at www.sam.gov. If not already registered, please register as soon as possible since failure to do so may preclude BSA from doing business with your organization. 4. Equivalent Guidelines:

The parts or model numbers are listed for reference purposes only. Any alternate products being offered shall have equivalent, or greater, performance parameters to those specified. Suppliers that are offering alternate products shall list the manufacturer, model, and part numbers for the product. When quoting an alternate product, please provide sufficient documentation to permit thorough evaluation of the equivalency of your offer to the product specified. BSA reserves the right to determine equivalency.

5. Basis of Award:

BSA will make award to the responsive and responsible offeror who submits the lowest total price and who meets all of BSA's technical requirements, as stated herein.

6. Pricing: shall remain valid for 60 days

Quotations will be opened in private. Quotations, including their withdrawal or modification, received after the closing date shall be considered late. Such responses will only be considered for award if it is in BSA's best interest to do so.

Any resulting purchase order will be subject to the attached Terms and Conditions.
