Background
The U.S. Food and Drug Administration (FDA) requires Third Party Tobacco Retail Inspection Services for Region 4 to enforce compliance with the Family Smoking Prevention and Tobacco Control Act. This act grants the FDA authority to regulate tobacco products to protect public health and reduce youth tobacco use. The FDA conducts compliance check inspections of tobacco retail establishments to ensure adherence to federal laws and regulations.

The goal is to establish contracts with states or U.S. territories for these inspections, and when not feasible, to engage third-party entities capable of hiring inspectors.

Work Details
The contractor will perform the following tasks:
1) Conduct inspections of retailers selling regulated tobacco products to determine compliance with federal laws;
2) Collect, document, and preserve evidence from inspections;
3) Support FDA in enforcement actions, including drafting declarations by inspectors and arranging testimony;
4) Respond to inquiries from the FDA regarding inspections and data.

The contractor must ensure that all inspectors are commissioned according to federal law and maintain qualified personnel throughout the contract duration.

Period of Performance
The contract will be performed over a period defined by task orders issued under an Indefinite Delivery Indefinite Quantity (IDIQ) framework, with specific timelines provided in each task order.

Bidder Requirements
Bidders must meet the following requirements:
- Small Business Set Aside - Total (SBA);
- Ability to hire commissionable inspectors who are health or food officers/employees of state or local governments;
- Provide evidence of past experience in similar inspection services;
- Maintain security clearances as required;
- Submit a detailed plan for staffing and program management.
