  1. Identification of the agency and the contracting activity:

The Department of State Office of Acquisition Management proposes to award task/deliver order under multiple award contract or a modification to an existing order with exception to fair opportunity for purchase of Quest Change Auditor software, on behalf of Information Resource Management, Enterprise Network Management Office (IRM/OPS/ENM). The total estimated cost is: $XXX

2. Nature and/or description of the action being approved.

This is a new order for the renewal of existing Change Auditor software with an expiring period of performance of the maintenance support coverage. Change Auditor software audits Active Directory changes made to Domain Controllers in the environment. Without this data, ISSOs and IRM upper management would not have audit information required for various reporting, including for FISMA and CDM, and would not be able to run ad hoc reports on an as needed basis.

3. A description of the supplies or services required to meet the Department's needs.

Change Auditor for Active Directory drives the security and control of Active Directory by tracking vital Active Directory configuration changes in real-time. Change Auditor tracks, audits, reports and alerts on the changes that impact your directory, including changes to users, groups, nested groups, GPOs, computers, services, registry, local users/groups and DNS - without the overhead costs of native auditing. In addition, Change Auditor for Active Directory allows you to lock down critical Active Directory, and Group Policy objects, to protect them from unauthorized or accidental modifications and/or deletions.

4. Authority permitting a Fair Opportunity Exception and the supporting rationale. This acquisition is conducted pursuant to 41 U.S.C. 4103 and 4106 as implemented by FAR 16.505(b)(2) and substantiated by the following:

FAR 16.505(b)(2)(i)(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

This request is to purchase specific software based on name-brand specification, Change Auditor. While the item is peculiar to a specific manufacturer, the reseller does not need to be specified. In this DoS Enterprise environment, we must keep track of authorized and unauthorized changes in Active Directory. Change Auditor allows for us to be alerted (regularly) to critical and non-critical changes made in the environment that can affect the security and functional operation of any one individual person or the entire enterprise.

5. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on market research, comparison of previous purchase prices found reasonable, or a comparison with similar items in related industry. By signing the justification the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable.

6. Any other facts supporting the justification.

As this is a brand name only justification, no one contractor's unique qualifications are used as the basis for this justification. Rather, the products identified by brand name herein have been identified as the only products that will meet the Department's requirements. Change Auditor software is already currently deployed throughout the Department of State. This software is already approved by the various governance approving bodies, and have been authorized for use on Department enterprise networks by the various security and information assurance organizations within the Department. Maintenance for this software is proprietary to the original manufacturer of the software, and no other tools have been determined to meet the mission need of ENM at this time.

7. Actions the agency May Take to Remove or Overcome Any Barriers to Increase Fair Opportunity before any subsequent acquisitions for the supplies or services is made.

As is prudent, IRM/OPS/ENM/NED will continue to conduct market research to attempt to identify competing sources that offer satisfactory material and service. This research will be conducted as part of the rebid or re-compete of this contract.
