USDA, Agricultural Research Service (ARS), Beltsville Agricultural Research Center (BARC) requires a Contractor to furnish all services, materials, supplies, labor, equipment, superintendence, and travel and administrative reports and plans as required for the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) program to meet its regulatory obligations as set forth under the 1998 Federal Facilities Agreement (FFA) between the Environmental Protection Agency (EPA) and USDA ARS. Specifically, the objectives of this SOW include tasks related to the College Park Landfill (CPLF) AOC: - Task 1: Feasibility Study (FS) Addendum - Task 2: Proposed Remedial Action Plan (PRAP) - Task 3: Record of Decision (ROD) The SCOPE OF WORK and TASKS are provided in more detail below. SCOPE OF WORK The Contractor shall furnish all services, materials, supplies, labor, equipment, superintendence, and travel and administrative reports and plans as required, related to the work described herein. The Contractor shall have a full understanding of all work completed to date, feedback and coordination from all regulatory authorities, and documentation and meeting minutes to date. TASK OBJECTIVES The Contractor shall prepare a Draft FS Addendum to the original 2009 FS for CPLF area of concern (AOC). The Draft FS Addendum will utilize EPA presumptive remedy for CERCLA municipal landfill guidance. The Draft FS Addendum will be submitted to ARS for review and comment, and upon acceptance by ARS will be submitted to EPA for review and comment. The Contractor shall prepare an RTC for each round of reviews and a redline strikeout version for concurrence. Upon final EPA concurrence, the Contractor shall prepare a Final FS Addendum. FS addendum will utilize EPA presumptive remedy guidance for landfills. The Contractor shall organize and attend conference calls and meetings, as needed, to address all regulatory concerns received from ARS and EPA and complete the Draft and Final FS Addendum. ***See SOW for additional details*** The source selection process to be utilized for this acquisition is best value. The technical, non-price factors are more important than price. Provision at 52.212-2, Evaluation-Products and Commercial Services (Nov 2021) applies to this acquisition. The Government intends to award a Firm Fixed-Price (FFP) contract. The award will be made on the basis of best value. Only one award will be made under this solicitation based on availability of funding. For this requirement, the offers will be evaluated by Technical, Past Performance and Price where Technical is more important than Past Performance and Past Performance and Technical are more important than Price. In order to be considered for award OFFERORS SHALL SUBMIT THE FOLLOWING: - Submit documentation showing technical capability to meet or exceed Performance Elements and Benchmarks in the Statement of Work. - Submit Past Performance documents - Submit Firm Fixed Price quotation (quote on company letterhead) detailing the item description, total price and valid for at least 60 days after receipt of quote. Item delivered FOB Destination inclusive of all costs. - Submit Unique Entity ID (UEI) with quotation. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) 452.211-74 Period of Performance (FEB 1988) The period of performance and delivery of this contract will be estimated from 5/29/2023-5/28/2026 (End of Clause) DISCUSSIONS: The Government intends to award without discussions but reserves the right to conduct discussions should it be deemed in the Government's best interest.
