Description

A limited source justification was approved on 15 July 2022.

For the following reasons it is appropriate for the government to limit this acquisition to one source under authority of FAR 8.405-6:

1. BD Max is the only PCR analyzer that meets all essential characteristics.

2. IAW FAR 8.004 agencies are encouraged to satisfy the requirement through a FSS before considering commercial sources.

3. There is only one capable source (BD Diagnostics) that holds a schedule under VA FSS 66 III (Clinical Analyzers, Laboratories, Cost-Per-Test) in which PCR analyzers are available.

4. A cost-per-test contract delivers a substantial savings over the purchase of the PCR analyzer and consumables as demonstrated in a lease versus purchase analysis.

5. Only one source, BD Diagnostics (the OEM), was found to offer the BD Max system with a cost-per-test solution.

This procurement used a FSS and was solicited and awarded in accordance with FAR Subpart 8.4.
