AN/TPY-2 Radars for Foreign Military Sales   3

It is the intent of the Missile Defense Agency (MDA) to issue a sole source solicitation to Raytheon Integrated Defense Systems (Raytheon), 225 Presidential Way, Woburn, Massachusetts 01801-1060 to manufacture and deliver up to two (2) AN/TPY-2 Radars for Foreign Military Sales (FMS) requirements and provide three years of follow-on operations and sustainment support. The solicitation requirements will include the Engineering and Logistics Support necessary to field the AN/TPY-2 Radars in support of the THAAD Ballistic Missile Defense System (BMDS). In addition to engineering, logistics and technical support, the solicitation requirements will also include: software, software support, training, spares and assorted technical publications. All AN/TPY-2 components to be delivered to the FMS customer will be integrated into an operational THAAD weapon system.

The proposed acquisition will be sole source to Raytheon pursuant to the authority of FAR 6.302-1(a)(2)(ii) & (iii) as the resulting contract is for highly specialized supplies and services where it is likely that award to any other source would result in substantial duplication of cost and unacceptable delays of the requirement. Raytheon is the prime sole-source contractor on the current AN/TPY-2 Radar Development and Production Contract HQ0006-03-C-0047 and the Consolidated Contractor Logistic Support Contract HQ0006-08-D-0003 which provides for the operation and sustainment support to AN/TPY-2 radars; in addition, Raytheon has developed and manufactured AN/TPY-2 radars as the primary subcontractor under THAAD Contract, DASG60-00-C-0072. No other company has manufactured the AN/TPY-2 radar or integrated the radar into a weapons system. Only Raytheon is capable of manufacturing critical AN/TPY-2 components and integrating them into the Radars and providing field support without substantial duplication of cost and unacceptable delays in fulfilling the agency's requirements.

The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability by responding to this requirement. This notice of intent is not a request for competitive proposals. However, all information received within sixty days after date of publication of this synopsis will be considered by the Government. Any party interested in this requirement should contact this office within 15 days after publication of this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
