AMENDMENT No. 3 Posting of DFAC Digital Photos and additional Q&As

Upon further research, the requirement number is incorrect.....the Amendment has one number, the draft has another number. Can you please advise or specify?

ANSWER: The Draft Solicitation takes precedence in all cases. However, it is noted that all information and data shared within SAM.Gov Amendments is the same as reflected within the Draft Solicitation document.

Amendment 1 - There are 2 references referred to Provisions & Clauses 252.204-2019, 252.204-2020 (does not exist, does not match) Can you please post a full text version. 252.204-7019, 252.204.7020.

ANSWER: Both DFARS clauses 252.204-7019 and 252.204-7020 are reflected within the Draft Solicitation document. All Defense Federal Acquisition Regulations (DFARS) clauses shown within the Draft Solicitation document are available for viewing full text by going to URL: https://www.acquisition.gov or https://www.gsa.gov

DFARS 252.204 7012 is a regulatory requirement that applies to all acquisitions within the Department of Defense (DoD),with the exception of Commercial Off the Shelf (COTS) items. It mandates that contractors establish controls to safeguard sensitive information and report any cyber incidents. This regulation is critical for maintaining the security and integrity of defense information, particularly when it comes to the handling of Controlled Unclassified Information (CUI).

Please clarify the NIST requirement regarding Commercial OFF The Shelf items.

ANSWER: This requirement is NOT a Commercial OFF the Shelf Item. Our office has confirmed through our Headquarters National Guard Bureau (NGB) senior leaders that this Commercial, DFAC Services requirement is NOT considered COTS, since this is a Services requirements. The term COTS refers to Commercial Off-the-Shelf supply requirements. All commercial services do apply against these NIST and SPRS requirements, at the Level 1, Self Assessment process conducted by the Contractor.

It is recommended that all Contractors contact their State, APEX office for immediate assistance or their nearest Federal, Small Business Association (SBA), Procurement Center Representative (PCR). This is a mandatory Department of Defense (DoD) requirement that applies to all Commercial Services contractors, with possibly only a few exemptions as noted within the NIST documentation.
