NASA/LARC intends to purchase the items from ABSL Power Solutions Inc. The System and Tank Heater Battery was ordered for EDU development in previous orders, and the associated interactions with other electrical components in the reentry vehicle have been designed with these specific parts as the baseline design. Awarding to a different vendor would lead to unacceptable delays in fulfilling NASA flight obligations. It would take substantial duplication of resources and time for another source to provide the required service and this additional expense is not expected to be recovered through competition.

Provision for this JOFOC is made under the statutory authority of 10 U.S.C. 2304(c)(1).
FAR Part 13.5 procedures are used under the statutory authority of 10 USC 2304(g)(4)
which requires NASA to follow 41 U.S.C.1901(e).

Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 12:00 p.m. local time on 05/28/2019. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.

All responsible sources may submit an offer which shall be considered by the agency.

NASA Clause 1852.215-84, Ombudsman, is applicable.
