Set-aside Status: This contract will be conducted on a sole source basis and will not be set aside for small business concerns.

Military Sealift Command (MSC) intends to award a Firm Fixed Price services contract to American Bureau of Shipping (ABS), to inclue a one-year base period and (4) four one-year option periods, on a sole source basis in accordance with FAR 6.302-5(a)(2)(i) Authorized by Statute. Per 46 U.S.C. 3316, the Government is directed to recognize ABS as its sole agent in classifying vessels owned by the United States and in addressing matters to classification. As a result, this acquisition will be conducted on a sole source basis and will not be set aside for small business concerns or for full and open competition. The activity's small business office concurs with this determination.

MSC has been directed by the Chief of Naval Operations to design, construct, operate, maintain, and repair MSC ships using practices and standards of the commercial merchant marine industry including those of ABS and the US Coast Guard (USCG). To that end it is MSC's intent to (a) Class all MSC public vessels in accordance with ABS rules, (b) Ensure all USNS ships are certified by the USCG where eligible, and (c) Voluntarily comply with Safety of Life at Sea (SOLAS), MARPOL 73/78, and other safety and environmental codes. ABS is a classification society headquartered in the United States. By statute 46 U.S.C. 3316, the US Government is directed to recognize ABS as its sole agent in classifying vessels owned by the United States and in addressing matters related to classification. Because MSC intends to class all of its public vessels, such classification services must be obtained from ABS.
