Notice of Intent to Sole Source for: 130 CHAMPS CMS Annual Maintenance Licenses
In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to CHAMPS, Inc. to renew 130 CMS licenses. CHAMPS Inc. is the sole provider. The anticipated period of performance would be a base period and four, one-year option periods. This is considered a sole source to CHAMPS Inc. because, to the best of the NETL's knowledge based on market research conducted CHAMPS Inc. is the only known source that can provide this type of service. In addition, replacing this software with another brand would have broad sweeping consequences with significant costs: underlying data structures and infrastructure changes that may be needed; migration of data to a new tool/structure would need to be planned and could result in a loss of service and further exploitation; users that may need additional training on the new product; technical resources to support the new tool may be required; additional hardware may be needed; and the decommission of the current product which could be costly. No known potential alternate sources exist which could satisfy NETL's requirement. No known potential alternate sources exist which could satisfy NETL's requirement.
This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 3:00 PM ET on January 24, 2023. Responses must be submitted in writing to the purchasing agent, Anissa Beasinger, via email at anissa.beasinger@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
