Background
The City of Milwaukie is seeking proposals from qualified and experienced businesses or individuals to provide contracted legal services as a municipal court judge. The municipal judge is appointed by the City Council and is expected to uphold the values of ethical conduct, fiscal responsibility, and responsiveness to the community.
The City aims to enhance equity and fairness in its contracting processes, encouraging participation from minority-owned, women-owned, veteran-owned, and emerging small business enterprises.
Work Details
The selected municipal court judge will perform judicial services including presiding over arraignments, hearings, trials, accepting pleas, imposing sentences, issuing warrants, and other judicial acts as authorized by law.
The judge will present semi-annual progress reports to the City Council. Court sessions are typically held twice a month on Wednesdays between 8:00 a.m. and 5:00 p.m., with adjustments based on caseload or operational needs.
Additionally, the judge will be responsible for maintaining case records using the City's court operations software (Tyler Technologies’ Incode Court) and ensuring compliance with applicable laws. The judge must also arrange for a pro tem judge when unavailable due to conflicts or other reasons.
Period of Performance
The contract will commence on or about June 1, 2026, extending through May 31, 2030, with an option for a two-year extension until May 31, 2032.
Place of Performance
The services will be performed within the City of Milwaukie, Clackamas County, Oregon.
Bidder Requirements
Proposers must be active members in good standing with no pending disciplinary actions with the Oregon State Bar; must be registered to do business in Oregon; and must have at least five years of experience in municipal or criminal law.
Proposals must include qualifications of key staff, documentation of a juris doctorate degree from an accredited law school, proficiency with court operations software, knowledge of Oregon municipal law and procedures, and three contact references.
