Background
The U.S. Food and Drug Administration (FDA), part of the Department of Health and Human Services, is seeking information from Venture Capital (VC) firms about a novel contract vehicle that would allow portfolio companies to compete directly for FDA contracts and task orders.

The FDA aims to engage with innovative companies developing breakthrough technologies in areas such as artificial intelligence, biotechnology, medical devices, and regulatory technology, which could enhance FDA operations and public health. Historically, the FDA's engagement with startups has been limited due to reliance on pass-through organizations and complex federal regulations that hinder direct interactions with innovative firms.

Work Details
The FDA is exploring the development of a contract vehicle that would: establish direct contractual relationships with qualified VC firms; enable any company within an approved firm's portfolio to compete for and receive task orders under this vehicle, treating portfolio companies as subcontractors; streamline the procurement process for innovative technologies and services; provide a scalable mechanism for engaging with the startup ecosystem; maintain oversight and compliance.

The FDA requests responses addressing experience and capabilities in areas such as investment focus, portfolio composition, barriers to functioning as prime contractors, structural support for compliance with government contracting regulations, financial stability requirements, ongoing certification processes for participating firms, and organizational structures to support this contract vehicle.
